Attorney General Steve Marshall files a lawsuit asking the Montgomery County Circuit Court to declare an Alabama Ethics Commission policy 'null and void.' alpolitics

Ethics Commission Executive Director Tom Albritton said his office disagrees with the attorney general but welcomes a review by a court.marks a breakdown between two agencies that in normal circumstances work together to enforce the ethics law, which is intended to prohibit public officials from using their positions for personal gain.

The lawsuit names as defendants Albritton and the four current members of the Ethics Commission . The attorney general and the Ethics Commission have disagreed on the policy about exculpatory information for at least a year. “Thus, the respondent can neither be confident that he fully understands the case against him, nor that the exculpatory evidence has been considered by the Ethics Commission before it votes on whether to refer the matter for prosecution or administrative resolution,” the attorney general’s lawsuit says. “In either case, the respondent’s legal defense is impeded.”
