Congress should reform the agency which unwittingly empowers patent trolls and promotes untrusted smartphone makers.
... [+]Congress founded the United State Tariff Commission, today’s United States International Trade Commission , in 1916. In the Progressive Era ethos of the time, “scientific management” was seen as the way to solve economic, social and political problems. In that spirit, Congress empowered the agency to apply scientific principles to the study and application of tariffs, and the Commission’s first Chair was a Harvard economist.
Electronics are a key domain for trolls, as any one smartphone may implicate hundreds of thousands of individual patents. The mere claim to the USITC that a single patent is being infringed is the opening salvo to banning the entire device from US import. And this threat poses intolerable risks for manufacturers, as the trolls well know.
Naturally, trolls have focused on leading smartphone providers like Apple, Samsung, Motorola, and Google, which have all been sued for patent infringement multiple times and have had to defend themselves in court and at the USITC. The latest set of claims at the ITC comes from Daedalus Prime, a recently chartered patent troll from Bronxville, NY for what appears to be the sole purpose of shaking down Samsung, the leading Android smartphone provider.
