'There is no evidence that the victim was suffering from any mental health issue, or had otherwise decompensated,' on the day he was killed, the judge ruled.

Ahmaud Arbery's mental health records can't be used as trial evidence, a Georgia judge ruled Friday, over concerns of jury prejudice.

Superior Court Judge Timothy Walmsley ruled that a registered nurse's"highly questionable diagnosis" that Arbery suffered from a mental illness during his first and only visit to a mental health services provider in 2018 could unfairly prejudice a jury. A judge ruled that Ahmaud Arbery's mental health records could not be used as trial evidence by defense attorneys for the white men who shot and killed him.
