Archie Battersbee has died, after his family lost a long-running legal battle over the withdrawal of his life support.
The 12-year-old’s parents Hollie Dance and Paul Battersbee, who are separated but both from Southend, Essex, had fought a long-running legal battle over the withdrawal of his treatment. When the legal process for this was exhausted, they changed their focus to trying to get their son moved to a hospice for the final days of his life.
Hollie Dance, mother of 12-year-old Archie Battersbee, outside the Royal London hospital in Whitechapel, east London, after the European Court of Human Rights refused an application to postpone the withdrawal of his life support In a High Court ruling on Friday morning, Mrs Justice Theis concluded it was not in Archie’s best interests to be moved from hospital to a hospice.“When considering the wishes of the family, why those wishes are held, the facilities at the hospice, what Archie is likely to have wanted… the risks involved in a transfer… and the increasing fragility of his medical condition, I am satisfied… he should remain at the hospital when treatment is withdrawn.
A spokesperson for the European court said it had received a request from representatives of Archie’s parents under Rule 39, which allows it to apply “interim measures” in “exceptional” cases, and that the complaints “fell outside the scope” of that rule, and so it would not intervene.
