A Black pastor who was arrested while watering his neighbors flowers filed a lawsuit against three police officers and the small, central Alabama city where he was charged, claiming his rights were violated by an unlawful and false arrest.
'I'm supposed to be here'
When Officer Christopher Smith, one of the three officers named in the suit, asks Jennings what he is doing, he tells them he is watering flowers. When Smith asks for identification, Jennings said he wasn't going to provide that because he had done nothing wrong. In the lawsuit, Jennings said the arrest was unlawful because he was on private property and he"had a clearly established constitutional right under the Fourth Amendment to be secure in his person from unreasonable seizure and not to be arrested without arguable probable cause to do so.
