It is understood that the legislation will call for the abolition of juries in High Court defamation actions.

Justice Minister Simon Harris will seek approval for draft legislation at Cabinet this morning that will reform Ireland’s draconian defamation laws.

It will also include measures to improve protection against online defamation and combat abusive defamation cases, including anti-SLAPP measures. There will also be a reform of the defence for live broadcasting in cases where a contributor unexpectedly makes a defamatory comment during a live broadcast. However, a broadcaster must be able to show that it took reasonable measures before and during the broadcast to prevent that from happening.
