The decision to remove the child from the facility was a 'fait accompli' after a report confirmed he had a disability, the Workplace Relations Commission (WRC) heard

A childcare facility that refused to continue providing services to a boy after he was diagnosed with autism has been ordered to pay €2,000 in compensation for discriminating against the child.

She provided this report to the childcare facility and subsequently attended a meeting with its management on May 3, 2022, when she was informed that her son would be finishing up in June. In its submission to the WRC, the childcare facility denied that it had discriminated against the child, claiming that they had made the recommendation in his best interests on foot of the psychologist’s report.

In his decision, WRC adjudication officer Brian Dolan noted that the childcare facility had met the boy’s needs but “matters became more complicated” after they received the report from the educational psychologist.
