Various articles of the Constitution, the European Convention on Human Rights and the EU Charter of Fundamental Rights are cited in the case, which is against the Minister for the Environment, the Government, Ireland and the Attorney General. Mr Justice Richard Humphreys granted the plaintiffs permission to proceed with their case, which he said was of “some complexity and difficulty”. The State parties have yet to be given a chance to respond to the plaintiffs’ allegations.
