An election petition by a sitting councillor seeking a declaration from Kerry County Council that he was eligible to run in the upcoming local elections has been dismissed on grounds of jurisdiction.

"Confusion" and concern over sitting councillor and retained firefighter Martin Grady's eligibility to run in the next local elections arose because of a circular issued by the department last year on the maximum pay local authority employees can earn and be allowed run for election.

The circular said that"all elements" received either directly or indirectly from the employer including allowances and call out and incident attendance payments for the previous year should be included. Legal proceedings were issued last week by Mr Grady of Ardshanavooly, Killarney, Co Kerry, against the council, with the department a notice party.

"Yesterday the department served upon us an amended and updated circular. It seems to address the main concerns in this case. Essentially it retracts from the circular sent in December," Ms Murphy said.
