Dublin Airport operator daa granted stay on enforcement notice which would affect 700k passengers
The Dublin Airport Authority has been granted a temporary High Court stay on a notice issued by Fingal County Council to reduce the number of nighttime flights in and out of Dublin Airport.
Yesterday, Mr Justice Conor Dignam permitted the daa to challenge the notice which accused it of breaching the terms of planning permission in respect of the new runway.The daa's reason for opposing the enforcement notice is that it regards it as flawed, unreasoned, vague and of no legal effect.The daa initially warned the court that a refusal of the stay would mean the cancellation of up to 4,000 flights in and out of Dublin Airport in the coming weeks, affecting over 700,000 passengers.
"Daa is proposing to only use North Runway from 6am to midnight rather than 7am to 11pm as set out in the current planning conditions and introduce a noise quota count system rather than a flight movement number cap."Firstly, the daa claims the council did not provide a comprehensive planning report detailing the precise ways in which the daa was breaching terms of planning permission.
