In an order issued on Thursday afternoon, the Supreme Court wrote: ‘The application to vacate the stay entered by the United States Court of Appeals for the 11th Circuit on Sept. 21, 2022, presented to Justice Thomas and by him referred to the court is denied.’Last week, Trump asked the high court to get involved in the documents case. He claimed that a federal appeals court did not have jurisdiction to take out roughly 100 classified documents from a review of the materials that the FBI seized.
Trump asked the Supreme Court to let a special master review the documents, which could have allowed his lawyers to access them and argue that they should be kept away from prosecutors. The Supreme Court’s rejection of Trump’s emergency request means that the documents that were marked as classified will for the time being not be seen by a special master.‘As this Court has emphasized, courts should be cautious before “insisting upon an examination” of records whose disclosure would jeopardize national security “even by the judge alone, in chambers”‘, the Justice Department wrote in a filing on Tuesday.
