Dublin letting agent suspended for six months after finding of improper conduct

A south Dublin letting agent has had his licence to operate suspended for six months after a finding of improper conduct was made against him by the Property Services Regulatory Authority. The letting agent, Michael Carr – who trades as New Ireland Lettings based in Faughart Road, Crumlin, Dublin – had a number of sanctions imposed on his licence following an investigation by the PSRA including a six-month suspension which took effect on February 3, 2025.

The inquiry arose following a complaint against Mr Carr by an individual who had engaged him to let and manage four residential properties. The allegations related to rents and security deposits not being transferred to the client as well as his failure to return keys to the property and to respond to communications from the client. The PSRA said it made seven findings of improper conduct against the letting agent and had specific concerns about a number of issues including Mr Carr’s failure to properly account to his client for monies received on their behalf. He was also found to have taken unilateral deductions from such monies without the authorisation or knowledge of his client. The PSRA said paperwork provided by Mr Carr in relation to those deductions did not align with the amounts or justify the deductions themselves. The regulatory authority also criticised the letting agent’s consistent failure to communicate properly with his client. It concluded he had also shown disregard for statutory provisions of legislation governing minimum standards for property services as well as relating to the money of clients. The PSRA said it took into account various factors in determining the appropriate sanction which included the suspension of his licence for a period of six months. Mr Carr was also ordered to pay €1,000 to the Property Services Compensation Fund and a further €3,000 to the PSRA to cover the full cost of its investigation into the complaint against him. The "major sanction" was not challenged by the letting agent and it was confirmed by the High Court last month.
