Leaders of Texas’ most prominent abortion funds implored a federal judge to give them clearance to resume providing assistance to people seeking abortions in states where the procedure is legal.

The groups halted abortion support operations in June after the Supreme Court issued its decision this summer overturning federal protections for the procedure. The decision also led clinics throughout the state to stop providingThe legal battle carries immense implications for thousands of Texans seeking abortions, who will inevitably incur higher costs as they depend on other states due to Texas' near-total abortion ban.

The Texas Supreme Court ruled in July that the state's pre-Roe statutes, which make it illegal to" the means for procuring an abortion," are enforceable. A state law passed in 2021, Senate Bill 8, also allows private citizens to file suit for at least $10,000 in damages against a doctor or any other person who “aids or abets” an abortion after six weeks gestation, before most know they are pregnant.

Anna Rupani, executive director of Fund Texas Choice, one of the plaintiff organizations, testified Tuesday that her organization had gone from being able to help about 90 percent of the hundreds of callers to its hotline to only about 30 to 40 percent since SB 8 passed.
