A retired senior garda has told the Special Criminal Court that the only way to listen to members of a crime gang whom they suspected of being involved in the murder of David Byrne was to bug a former Sinn Féin councillor's vehicle.

He also said that Dowdall brought Gerard Hutch, the man known as the Monk, to Derry two weeks later on 18 January 2016. Mr Johnson told the court that gardaí had gathered intelligence that Jonathan Dowdall's Land Cruiser was being used by Jonathan and Patrick Dowdall and members of the organised crime group and their associates to travel to meetings.

He was granted the authorisation to bug Dowdall’s jeep from 17 February 2016 to 16 April 2016 and to enter it"by reasonable force" without his knowledge to install and withdraw the audio-recording devices. "More disturbingly still," he said,"we were told [this happened] during the currency of this prosecution, not the trial, since Mr Hutch was brought before the court."
