Officer Eric Garcia, who told investigators he was tracking an armed man when he shot the 20-year-old woman in the arm, will not be charged.

Garcia said in a statement to investigators that he was tracking a man who got out of the driver’s seat of a Jeep holding a gun. The woman, who was a passenger in the SUV, suddenly appeared in front of him, he said. George Gerken, an attorney for the police union that represents Garfield Heights officers and who defended Garcia, said the officer was happy with the grand jury’s decision.
Garcia, who was a field training officer patrolling with a rookie officer, and officers in two other police cruisers tried to set up a road block as the one of the SUVs sped away from the shooting, Awadallah said. That SUV drove up on the curb to avoid the blockade and sped off, the prosecutor said. Johnson jumped out of the driver’s side as Garcia and his partner came up to the Jeep, and officers saw he was holding a gun. Awadallah said the gun is visible on the body camera videos recorded by cameras that Garcia and his partner were wearing.
Garcia then stayed with the woman until an ambulance came and took her to University Hospitals for treatment. Garcia’s partner chased after Johnson, who tossed the gun, Awadallah said.
