The challenge stems from Dr. Fagan's urgent application for an order to halt the commencement of works until further notice or resolution of his legal case.

The council's barrister argued that there was no immediate emergency justifying the application and that any work starting before the end of the year would be considered 'exempted development.' If works do not commence until 2025, the project would require a fresh planning process under part 8 of the Planning and Development Regulations
