Around 550 retail stores owned by charities were previously subject to commercial rates, a property-based tax that nonprofits have been fighting for years as the funds from their shops are for charitable purposes.
In October, Judge Siobhan Phelan ruled the valuation tribunal failed to properly consider that a Vision Ireland charity shop in Virginia, Cavan, is a registered charity with a charitable purpose of fundraising through its shop. Judge Phelan said the tribunal incorrectly focused on what the property was being used as – a retail store – rather than what its purpose was – raising funds for charity. Now, around 550 charity shops across the country will be freed from paying this commercial tax and can funnel the money back into their services. Chris White, CEO of Vision Ireland, said the ruling means the charity will be €450,000 better off annually. It currently has 121 shops across the country. Overall, charities in Ireland will be €2.1 million better off every year as hundreds of shops will be exempt from the annual rates. Mr White said: “This has been a long process. We have been through various tiers of the legal system going back to 2018 and we have finally gotten the result. “We pay €450,000 for the year in commercial rates, but that money can now be used directly for services. We have 296,000 people in Ireland with sight loss and this ruling allows us to deliver half a million euros worth of more services to those people. “This is a great day and a great result for Ireland, The Irish Cancer Society, Oxfam, and animal welfare charities, it’s putting €2.1million back into the pockets of all these worthwhile charities because it will apply to all of them.” Mr White said an extra €450,000 will take pressure off the charity which has to fundraise €4million a year for its services. He added: “It’s a huge amount of money going back into the charity, we had the wherewithal to stick at this because a number of charities had given up or didn’t have the financial wherewithal to do this and we stuck with it for the best outcome for the whole sector.” The Vision Ireland CEO said charity shops are fantastic for fundraising, especially as they are growing in popularity.
