CLEVELAND, Ohio -- A judge on Monday formally declared that Ru-El Sailor was wrongfully imprisoned for 15 years for a 2003 murder that he didn’t commit.after Cuyahoga County prosecutors agreed that he did not kill Omar Clark, that he should have never gone to trial in the first place.The declaration clears the way for Sailor to collect money from the state’s wrongful imprisonment fund for each year he spent behind bars.

“I’m just glad that my kids know that I was innocent,” Sailor said, turning to his children sitting behind him. Sailor and Cordell Hubbard were both charged. Sailor, who was 23 at the time, falsely testified during the trial that he was barhopping with Cordell Hubbard the night of the killing. His attorneys said that Sailor was confident he wasn’t going to get convicted because he was innocent and wanted to give his friend an alibi.

Even after Sizemore came forward. Sailor’s then-girlfriend, Amy Spence, and his attorney Kim Corral brought public attention to Sailor’s case during the 2016 primary election for county prosecutor in which O’Malley ousted then-Prosecutor Timothy McGinty. Russ Tye, a former prosecutor in O’Malley’s office who oversaw the review of Sailor’s case, watched Monday’s hearing from the courtroom doorway. Tye patted his chest and extended his fist to Sailor from across the room after the hearing.

Miday pointed out that, while Sailor was imprisoned, prosecutors filed a lien against him because he did not pay court costs for the trial in which he was wrongfully convicted. She also pointed out that after his release in 2018, he spent two years on probation and had to wear a GPS ankle monitor.“On behalf of this court, I extend a sincere apology for what you have endured for the last 18 years,” Miday said.
