In his latest annual report, Matthew Deery has called for legal changes to restrict the circumstances in which gardaí can apply for exemptions to fixed charge notices
The judge tasked with monitoring the cancellation of fixed charge notices for motoring offences has said he ‘remains uneasy’ at the practice of gardaí claiming exemptions for speeding while performing routine duties.
Mr Deery suggested that gardaí should be required to show why it was necessary to exceed the speed limit, adding that he hoped progress would be made on this issue “in the near future”. The 11th annual report, which was published yesterday by the Department of Justice, was based on a random sample of cancellations. Mr Deery said he would not disagree with the manner in which discretion had been exercised in these decisions.
However, Mr Deery suggested that a third criterion should be introduced, requiring gardaí to show why it was necessary to break the speed limit in the particular circumstances.
