A High Court judge threatened to have controversial businessman Marcus Sweeney removed from court after he repeatedly attempted to raise his wealth management company case against the Criminal Assets Bureau (CAB). Mr Justice Alexander Owens, who previously ruled in favour of the CAB, stated that Sweeney was 'making a nuisance of himself' and that the case was already settled. Sweeney, who is known for his connections to the infamous 'Celtic Tiger' era, argued that the case was not settled and requested permission to re-enter it. However, the judge insisted that Sweeney needed to follow proper legal procedures if he wished to appeal or raise any further claims.
A High Court judge threatened to have Celtic Tiger socialite Marcus Sweeney thrown out of court after he asked the judge 'Am I up to my oxters?' when trying to raise his wealth management company case brought by the Criminal Assets Bureau (CAB). Mr Justice Alexander Owens told Sweeney - who he described in 2023 as “up to his oxters in organised crime” - that he was “making a nuisance of himself” when he appeared before the High Court today.
Two years ago Mr Justice Owens ruled on an application from the CAB seeking to deem Co Meath lands linked to Mr Sweeney’s firm EWM Property Holdings Limited the proceeds of crime. The CAB alleged EWM purchased the land for €102,000 using, in part, cash from unknown sources, another investment company and from an innocent investor. The judge said the bureau made out a ‘very compelling case’ for him to rule that there was a ‘high degree of probability’ that the site at Waynestown was acquired by EWM with crime proceeds. The bureau seized and sold the land after the ruling. On Wednesday, the former socialite and ex-fiance of the late model Katy French, whose case was listed on the hearing court list, told the judge he was “looking for consent and liberty to re-enter the case.” Mr Justice Owens said he “allowed Mr Sweeney to mention it on Monday,” but that he is “none the wiser as to what he wants to do.” Mr Sweeney, who ran Il Pomo D’Oro restaurant on Dublin’s South William Street before a receiver was appointed in 2017, told the judge: “The case is not settled as far as I am concerned.” However, Mr Justice Owens told the 47-year old he received a settlement agreement on behalf of the company and made final orders on foot of the settlement agreement. “The liberty to re-enter relates to simply enforcing the agreement,” the judge said, telling Mr Sweeney if he has some other case to set aside or some personal claim which can be brought it’s necessary to bring an application of notice via a notice of motion so I can see what it is all about.” “I can’t entertain any submission or document in the way you have started,” Mr Justice Owens continued, adding he hadn’t a “hint nor hair what you are on about. “You can’t turn up willy nilly, you have to invoke paperwork,” the judge remarked. Barrister for the CAB Grainne O’Neill, BL said Mr Sweeney “wants to appeal the order.” However, Mr Justice Owens said Mr Sweeney “can’t land into court in front of me and make any order they want. As far as I am concerned it’s finished unless you set aside an appeal.” In response Mr Sweeney said: “Please don’t entertain me if you don’t wish to. I brought the CAB to court on behalf of the company. When Mr Sweeney said: “I have the right to speak,” Mr Justice Owens told him he didn’t, to which Mr Sweeney then asked the judge to “Please answer, am I up to my oxters?” Mr Justice Owens then told Mr Sweeney he was “going to ask the duty guard to remove you.” “You are making a nuisance of yourself,” Mr Justice Owens told Mr Sweeney. “If you want to bring an application relating to the decision there is a court process. “This isn’t a soapbox for litigators to get up and say what they want,” Mr Justice Owens said and told Mr Sweeney to “Go away.
