The Workplace Relations Commission ruled that the comment represented 'blatant racism' by the landlord and constituted discrimination against his tenant on grounds of race
A landlord has been ordered to pay €10,000 compensation to his Afghan tenant whom he claimed needed to be "sent out of this country instead of trying to claim from the Government."
Mr Refah accused his landlord of discrimination by treating him less favourably than an Irish tenant by questioning his legal right to be in Ireland. He claimed his character was impugned by doubt being cast by Mr Corless over fleeing his country and being separated from his family for six years. The complainant said he bought paint and off-cuts of carpet to decorate the apartment himself after the landlord said quotes he had got for the work were too high.
Mr Refah said he got no reply to an e-mail he sent the landlord on July 17, 2023 requesting that the bathroom ceiling be fixed as well as informing Mr Corless that two heaters were broken, while locks, doors and windows also needed to be repaired. He explained how it had not been safe for him to remain in Afghanistan where he used to work for a NGO which involved encouraging young girls to attend school, since the Taliban took control of his home country.
In May, the RTB ordered Mr Corless to pay Mr Refah a sum of €3,000 in damages for breaching his landlord obligations to carry out necessary repairs to the apartment and a further €500 for failing to allow his tenant to enjoy peaceful and exclusive occupation of the dwelling.
