A selfish man who was HIV positive slept with a woman repeatedly and did not tell her, resulting in her falling "gravely ill" after contracting the life-threatening virus.
The woman, Leeds Crown Court heard on Tuesday, became gravely ill and was taken to hospital where it was discovered she had contracted HIV. Prosecutor Gillian Batts said: "She sent the article to her cousin and they spoke on the phone and she described her as sounding distraught and in fear of the consequences. They spoke again the next day and it was the cousin who contacted the police.
It was also said that Shaw, of Town Street in Armley, often missed appointments and failed to collect medication to manage his condition and reduce his risk of infection to sexual partners. Ms Batts said those diagnosed with HIV are given advice to give to sexual partners about medication that can be taken to decrease the risk of it being contracted, if there is a probability it has.
The court heard Shaw went on to plead guilty to section 20 grievous bodily harm at a plea, trial and preparation hearing. He already had a number of previous convictions for offences including a number of breaches of restraining orders, harassment and battery. "I had to wait for the results to come back. I felt like I was waiting for a life time. When they told me the results I was still extremely ill. I had a rash which I was told indicated I was close to passing away....If it wasn't for my initiative to search for him on Google, he wouldn't have told me and I would have likely passed away - the hospital wouldn't have known to check for it.
"He was playing this very dangerous game with someone else's health...He has been totally reckless and it was born out of a shame and embarrassment he had for his condition."Judge Bayliss jailed Shaw for three years and four months, telling him the maximum sentence for the offence is five years, which was reduced due to his guilty plea and mitigation.
