Three lifeguards are on trial for breaching their duty of care after the death of Christopher Rogers while swimming at a leisure centre in Northern Ireland. A top water safety expert told the court that the lifeguards 'waited too long' to initiate a rescue and missed signs that the accomplished swimmer had lost consciousness under water. Dr Daniel Jacklin cited multiple faults and failings, including a prolonged handover between lifeguards, asking a member of the public to check on Mr Rogers, and waiting too long to initiate a rescue attempt.

The “thumbs up” sign, he told the court, was in keeping with Mr Rogers experiencing “decerebrate posturing” where his hands and limbs had “curled up” and that had been misinterpreted.Aoife was diagnosed with HIV in Australia in 2020: ‘He was unknowingly positive. On Tuesday Dr Jacklin, who has a consultancy role with the Royal Life Saving Society, said he believed that when Mr Rogers broke the surface of the water, he had already suffered a heart attack brought on by a lack of oxygen. Dr Jacklin said it also should not have been left to the other swimmer to check on Mr Rogers and that the signs of his distress ought to have been seen earlier and a rescue initiated.
