A 29-year-old man has received a suspended sentence for assaulting his former partner and her teenage brother while threatening to harm her unborn child . The incident occurred in November 2020 at the woman's home, where the man, who cannot be named for legal reasons, disregarded a barring order and entered the residence. He proceeded to choke and punch the pregnant woman, causing injuries to her face and leaving her in fear for her unborn child 's safety.
The woman's 15-year-old brother was also present during the attack and was struck by the assailant. The man refused to leave the premises, blocking the exit and forcing the woman to escape through a window. She sought refuge at a neighbor's house before contacting the Gardaí.The court heard that neither the woman nor her brother provided victim impact statements. Additionally, the child, born after the assault, is now being cared for solely by the man, who has ten previous convictions. The defense argued that imprisonment would jeopardize the children's well-being, as they would likely be placed in care. They emphasized the man's efforts to maintain the family unit and his completion of a domestic abuse course. While acknowledging the seriousness of the assault, Judge Martin Nolan ultimately decided to suspend the two-year prison sentence, citing the man's role as the sole caregiver for his children
