A Co Donegal man who got somebody else to sit his driver theory test so he could obtain a provisional licence has received a suspended jail sentence.
He is charged that he did have in his custody an instrument to wit, Driver Theory Test Certificate, which was, and which he knew or believed to be, a false instrument with the intention of inducing another person to accept it as genuine and by reason of accepting the said instrument to do some act to the prejudice of that person or another person.
The court was told that a licence had been issued to Cirpaci, of Celtic Apartments, Pearse Road, Letterkenny, but later invalidated. Solicitor for the accused, Mr Patsy Gallagher, said the 'slight' issue for his client was the photograph issued along with the theory test. Judge Liddy asked if the accused man had been driving since getting the provisional licence under fraudulent circumstances. Inspector Byrne said he was not sure but that there was no evidence to suggest he was.
