A trial date has not yet been set for the former Newark police officer.
A psychiatric report commissioned by the defense says his mental state meant he couldn’t have intended to kill her— but the state doesn’t want a jury to see that report.

Authorities have said Formisano, who was off-duty but still wearing his Newark police uniform, shot Solaro-Formisano and her boyfriend after seeing them together in the home the Formisanos once shared.The 80-page report, written by a doctor hired by the defense who examined Formisano, found that his major depressive disorder, post-traumatic stress disorder, and, prevented him from forming the intent to kill the night of the shooting.
Judge Noah Franzblau, the third judge to preside over the case, did not make a ruling on whether or not the jury could see the report. A second hearing will be held April 28, where the doctor who wrote the report will testify and a decision will likely be made. An insanity defense argues that a defendant did not know what he or she was doing. This defense can result in a “not guilty by reason of insanity” finding by a jury.
