A key provision held that whenever there were questions about what information to make public, a law should be “broadly construed if it furthers the people’s right of access, and narrowly construed if it limits the right of access.” Eighteen years later, it’s as if this proposition doesn’t exist in San Diego.
The former cases may just reflect poor judgment but the latter cases may involve dishonesty, a far more serious and concerning situation. Whatever the specifics, there are genuine reasons to worry about City Attorney Mara Elliott’s views on this issue, given herfor state legislation that would introduce new hurdles to the public records request process.
