An 18-year-old has been charged with aggravated burglary after a 14-year-old boy was allegedly stabbed with a 'Zombie-type' knife during a break-in. The victim remains in intensive care after the attack at a house in Greenford Avenue, Dublin. The teenager, Luke Gilligan, was granted bail but faces strict conditions.
A teenager has appeared in court charged with aggravated burglary where it is alleged a 14-year-old was stabbed with a ‘Zombie-type’ knife and remains in ICU. The 14-year-old boy was left “soaked in blood with multiple injuries to his head and torso and a stab wound to his upper abdomen and had difficulties breathing,” Blanchardstown District Court heard.
Luke Gilligan, 18, of Greenfort Park in Clondalkin, Dublin 22, appeared before Judge David McHugh on Thursday where he was granted bail following a contested bail application. Detective Garda Tomas Barrett gave evidence he arrested Gilligan at 6.34pm on Wednesday, February 5 and charged him at 7.03pm where the accused made ‘No reply’ after caution. Det Gda Barrett said the accused is charged with aggravated burglary “which is a serious charge with a maximum penalty of life imprisonment.” Objecting to bail being granted, Det Gda Barrett outlined the alleged facts of the case saying it is alleged the 14-year-old boy was in a house in Greenford Avenue “playing video games and eating sweets with friends. It is alleged Gilligan was one of four to five males who entered the property and allegedly smashed a glass door before a struggle allegedly ensued and the 14-year-old “was struck over the head and stabbed.” Det Gda Barrett said it is alleged there is CCTV audio and visuals from nearby properties and a voice can be heard shouting “Luke, Luke, Luke.” The detective said during the alleged incident, it is alleged a scooter was taken and allegedly found in a neighbouring garden. “A ‘Zombie-type’ knife was found hidden in the gap of a wall in a nearby property,” Det Gda Barrett alleged. The injured boy is alleged to have fled to his grandmother’s house in a distressed state “saying he had been stabbed,” said the detective, adding “there is a lot of fear in the estate.” “The injured boy was taken to Temple Street hospital where he remains in ICU with a punctured lung and bruised liver and is traumatised from the incident,” said Det Gda Barrett. He said Gilligan was arrested half an hour later wearing “a black woollen hat with a bobble on top and a blue tracksuit.” Defence solicitor Wayne Kenny challenged the evidence during the bail hearing saying the Detective did not explain “who or what the statements are” that were put to the accused. Judge McHugh gave his ruling that he is satisfied the evidence doesn’t exist to refuse bail despite it being “a most serious allegation.” “He enjoys the presumption of innocence and the objections to bail fall short and I have to act on the evidence given,” the judge said. Granting bail, the judge imposed strict conditions - including obeying a curfew, signing on seven days a week at a garda station, to stay away from the alleged injured boy and his family, not to be on any electric scooters and not to wear any face coverings. The judge also warned the accused “You are entitled to the presumption of innocence but it is a most serious crime you have been charged with. “If there is the slightest breach you will be brought before the court again and almost certainly have your bail revoked,” the judge warned and remanded the accused on bail to appear before the court again in May for mention. No directions from the DPP have yet been received. Legal aid was granted after the court heard the accused is unemployed.
