According to court records, Maeve's death is attributed to 'culpable negligence' by her parents. The incident occurred on November 26, 2022.
The allegations against Kodi Simon, a former Marine Corps veteran, state that he placed Maeve in a Pack N' Play with a foam mattress and a suitcase filled with books on top. This action is believed to have caused mechanical asphyxiation, leading to the child's death. Court documents reveal that Maeve had a history of sleep disturbances and frequently climbed out of her crib, prompting her parents to attempt various methods to confine her. They tried a Pack N' Play, a zip-on mesh top, and a sleeping bag, but Maeve managed to escape each time. The report states that the parents' actions, while not intended to cause harm, ultimately resulted in Maeve's death. The investigation revealed that Kodi Simon had tucked his three children into bed, hearing Maeve 'babble' for about 15 minutes before silence, leading him to believe she was asleep. When he and his wife returned home later, they were unaware of the tragedy that awaited them the next morning. They discovered Maeve lifeless under the suitcase and other items crushing her neck. Kodi Simon waived extradition and is currently being moved from Ohio to Florida. Kateri Simon was released on a $20,000 unsecured bond. Both parents are facing charges of involuntary manslaughter
