Cahir O’Higgins was transferred to Loughan House open prison in Co Cavan on Sunday evening.
This leading criminal defence solicitor has been transferred to an open prison – less than a fortnight after being locked up for more than two years.
Mr O’Higgins, 50, was already serving a 16 month jail term for the assault causing harm to and harassment of fellow solicitor Stephen O'Mahony when the fresh sentence was handed down in Dublin Circuit Court on November 25. But sources did confirm O’Higgins, of Cahir O'Higgins and Company, Kingsbridge House, Parkgate Street, Dublin, was in the open prison. And sources insisted he was a perfect candidate for such a move.
“A prisoner’s suitability for transfer is reviewed at a formal sentence management meeting, where a multi-disciplinary team determines whether the individual meets the necessary criteria. In cases of prisoners serving shorter sentences or those convicted of non-violent offences , a formal review process may not always be required.
O'Higgins was convicted at the start of November of one count of theft and four counts of attempting to pervert the course of justice in relation to his dealings with a client. He had denied the theft of €400 on July 30, 2016 and that he attempted to pervert the course of justice in December 2017 by providing notes to gardai which he knew contained incorrect information.
