Two men aged 25 and 27 have been charged with the rape and false imprisonment of a woman at Ceannt Railway Station car park in Eyre Square, Galway. Remanded in custody after DPP directions are awaited, with one defendant citing his recent marriage as reason for bail.
Two men have been charged with the rape of a woman at the car park of Ceannt Railway Station in Eyre Square, Galway, on August 1st. The pair, aged 25 and 27 and who cannot be identified for legal reasons, appeared at Galway District Court via video-link from prison.
Alongside the rape charges, both men face accusations of falsely imprisoning the alleged victim, an offence contrary to section 15 of the Non-Fatal Offences Against the Person Act. The accused had previously been refused bail by the District Court, and their subsequent applications for bail in the High Court had not yet been heard at the time of the latest court sitting.
At the hearing, Garda Sergeant Damien Prendergast informed the court that the files relating to the co-accused were in the possession of the Director of Public Prosecutions, though DPP directions were still awaited. Defence barrister Donal Cronin confirmed the bail history of his clients and noted that their bail hearings were listed for the coming Thursday, although he stated that he had no control over whether those hearings would proceed as scheduled.
The younger of the two men told the court through an Arabic interpreter that he had recently married and wished to be released on bail so that he could be with his new wife. The interpreter was present to explain the proceedings to both defendants throughout the hearing before Judge Fiona Lydon. Sergeant Prendergast requested a four-week adjournment until October 5th to allow sufficient time for DPP directions to be received.
However, neither of the accused consented to this extension. Judge Lydon instead decided to remand both men in custody and adjourned the matter for a shorter period of two weeks, with the next hearing scheduled for September 21st at Galway District Court, again to be conducted via video-link.
She further directed that the men would be required to appear in person on that occasion if their High Court bail applications were to proceed and were successful, ensuring that any release would be properly processed through the courts
