Panda Waste Management Solutions is to face trial on indictment in the Circuit Court on six charges relating to the death of Radu Alexandru Chertes at its Finglas facility in April 2022.
Prosecution proceedings have commenced against a waste management company following an investigation into the death of an employee, Radu Alexandru Chertes, who died in April 2022.
Starrus Eco Holdings Limited, which trades as Panda Waste Management Solutions and is based in Tallaght, appeared before Judge Anthony Halpin at Dublin District Court on Monday. The company, which has yet to enter a plea, faces six charges under the Safety, Health and Welfare at Work Act 2005.
Judge Halpin noted that the Director of Public Prosecutions has directed that the case be sent forward for trial on indictment in the Circuit Court, a venue with broader sentencing powers than the District Court. The State applied for an adjournment of four weeks in order to complete the preparation of a book of evidence, which must be formally served on the defendant before any return for trial order can be granted by the court.
The charges relate to an alleged incident that occurred on April 6th, 2022, at the company's premises on Cappagh Road in Finglas, Dublin 11. According to the prosecution, the firm failed to ensure, so far as was reasonably practicable, the safety, health and welfare of its employees.
The specific allegations include that the company failed to maintain a safe system of work, failed to put adequate control measures in place, and failed to provide proper training, instruction, and supervision for staff involved in clearing blockages in an M&J Pre-Shred 4000S machine. The charges state that as a direct consequence of these alleged failings, Radu Alexandru Chertes sustained injuries from which he died.
At the opening of the inquest into the death in November 2022, the deceased's brother, Andre Chertes, who had also been employed at the Panda facility in Finglas, gave evidence of formally identifying his brother's body to gardaí. The inquest has been adjourned pending the outcome of the ongoing criminal proceedings. No date has yet been set for the trial in the Circuit Court, and the company continues to operate while the case is being prepared.
The matter highlights ongoing scrutiny of workplace safety standards in the waste management sector, particularly in relation to the operation of heavy industrial machinery and the responsibilities of employers under existing health and safety legislation.

Ronan Meleady, UL: 'Talk to people at Higher Options - that's what they're there for, to talk to you and help you make your decision'I attended Higher Options in 2022. It was something that was organised by our school, thankfully. It was mainly because it really gave a good insight into all the different courses that were on offer. Dublin colleges have lots of open days, as does Galway, but I'm from Waterford and travelling up and missing days of school to go to all of these open days wasn't really feasible for me. Higher Options gave me an option to actually see these courses and talk to the people without having to make the big long trek to all the colleges further up the country.
