A woman left traumatised by a not proven verdict on the man accused of raping her believes plans for juryless trials are vital to improve conviction rates.
After the case was reviewed by the National Rape Investigation Unit of Police Scotland, set up in 2013, it was established there had been enough evidence to charge the man. The Police Independent Review Commissioner later slammed the by then-defunct Northern force for its treatment of Esther, upholding eight of 15 complaints she made.
“My case was complicated because of the way I was treated by police, a lot of time had passed and not all the evidence was presented in court. “A judge would have been more aware of how exceptional those lengths were and would have been more likely to convict.” “This is a necessary proposal because we don’t have a system now that’s capable of convicting most accused even when there is enough evidence.”
