A UK-registered nurse was suspended for three months after being found administering Botox without proper authorization in Ireland. The nurse, Anne Marie Kelly, cooperated with inspectors who seized medication not legally authorized for use in the Republic. While no patient harm was reported, the committee deemed the incident serious misconduct.

A UK-registered nurse, Anne Marie Kelly, has been suspended for three months by a fitness to practice committee of the UK’s Nursing and Midwifery Council. The suspension comes after Ms Kelly was found administering Botox at the ACE Clinic in Letterkenny, Co Donegal, in August 2019. Health Products Regulatory Authority (HPRA) inspectors discovered Ms Kelly carrying out the procedure at the rear of the premises.

They seized all medication found on site, which included Botox intended for patients from Strabane, Co Tyrone, but not authorized for use in the Republic of Ireland. The medication bore UK licensing numbers and was therefore not legally on the market in the Republic. Ms Kelly cooperated with the inspectors and expressed surprise at not being authorized to administer Botox in the Republic. She admitted to administering Botox to 18 patients over three visits to the clinic and stated that she had only recently begun providing aesthetic treatments. In the Republic, only doctors, dentists, and registered nurses operating under the direction of a doctor can administer Botox. Ms Kelly admitted to several charges, including seeking to represent medication intended for patients in Northern Ireland when she intended to use it for patients in the Republic. The committee found that Ms Kelly was guilty of serious misconduct and dishonesty but determined that no actual harm was caused to patients, and they were not at risk of unwarranted harm. The committee decided that the risk of repetition was very low and that Ms Kelly's fitness to practice was impaired on public interest grounds only, with no public protection concerns arising from its decision
