Kenny has firmly stated that he will not allow Bartra access to his property, asserting that their financial ambition should not supersede the legal protection afforded to wildlife. \Kenny emphasizes that the development is a purely financial endeavor for Bartra, whereas for him and his wife, it's about environmental conservation. They have planted native trees and diligently care for the surrounding ecosystem. He criticizes Bartra's proposal for an artificial badger sett, claiming they are ineffective. \Bartra's planning consultants, Thornton O'Connor Town Planning, and their legal representatives, McCann Fitzgerald, have submitted new information to An Bord Pleanala, the planning appeals board, focusing primarily on the badger issue. They argue that a mitigation strategy involving the permanent closure of the sett during the non-breeding season and the construction of an artificial sett would be sufficient. McCann Fitzgerald maintains that destroying the sett is permissible if carried out in accordance with planning permission. However, Kenny argues that ordinary citizens shouldn't have to defend wildlife habitats and that state institutions should be responsible for this crucial task. The Kennys are scheduled to submit their own response to An Bord Pleanala by February 11th, with a final decision on the application expected in April
