Virgin Media Ireland has successfully appealed a €30,000 discrimination award given to long-serving schedule planner Sian Shepherd by the Workplace Relations Commission (WRC). The Labour Court found that Shepherd did not provide sufficient evidence to support her claim of discrimination based on her parental status after she was unsuccessful in applying for a promotion.
Television company Virgin Media Ireland has succeeded in its bid to overturn a €30,000 discrimination award to a long-serving schedule planner.
After a hearing in the appeal case earlier this month, Mr Haugh stated that, by Ms Shepherd’s own admission, the candidates that were placed ahead of her in the promotional competition were both parents of young children. “Prior to maternity leave I was the most senior member of the team, with the most experience and trained every other member, including the successful candidate. Where there had been gaps in management I was the acting leader, taking on additional responsibilities and being the point of contact for other departments.
Mr Haugh stated that, while presenting her case to the court, Ms Shepherd had said the core of her claim was that she had been marked down in the interview process on the flexibility and attitude criterion because she was the parent of a young child.
