Pamela Kirby (42) claims she fell while exiting a lift at Hotel Kilkenny and experienced such intense pain she believed she was going to die. According to Kirby, the incident occurred on August 18th, 2018. She is suing Hotel Kilkenny Ltd trading as Hotel Kilkenny for the fall. Hotel Kilkenny, however, maintains that Ms Kirby experienced an unfortunate accident when she lost her balance while wearing five-inch stilettos. They deny that the floor was wet or slippery at the time.

In the High Court, Mr Justice Tony O’Connor was informed that while both parties agree a fall took place, the hotel asserts Ms Kirby's stumble was due to her high heels. A duty manager who inspected the area after the incident is expected to testify that the floor was dry. Ms Kirby refutes the hotel's account, insisting she slipped on a tiled area outside the lift. She stated that a friend sent her a photograph of a yellow wet floor sign on the carpet near the tiles after the accident. During her testimony, Ms Kirby explained she was wearing professionally shortened shoes, a regular part of her footwear. She and her husband had attended the wedding and a drinks reception at the hotel, where she consumed two glasses of wine with ice. When the call for the wedding banquet went out at 5.30pm, they went upstairs to the second floor for the meal. Ms Kirby claims she followed her husband and other couples out of the lift when she slipped and fell, landing on her right side. She detailed the impact the fall has had on her life, stating she can no longer cycle, work overtime as a nurse due to her inability to lift patients, or participate in her previous running activities. She now relies on a personal trainer for fitness and can only wear runners. Ms Kirby emphasizes the fall's significant impact on her daily life
