The incident occurred in August 2023 at a pedestrian crossing in Carrigaline when Moynihan's Ford Ranger pickup truck collided with André Castro Ladeiro while he was cycling across.André's mother, Filipa, described the day the family's cycling trip turned into a nightmare in a poignant victim impact statement. She recounted the five agonizing days following the accident, culminating in the worst imaginable scenario. The family expressed that while seeing Moynihan imprisoned offered a semblance of solace, it did not fully alleviate their pain. They questioned if the sentence adequately reflected the magnitude of suffering inflicted and whether it aligned with societal expectations of justice in modern Ireland. They poignantly inquired if this outcome truly measured the value of a child's life filled with potential and promise.The statement further highlighted the devastating impact on their younger son, who grappled with daily reminders of the tragedy. He relived the horrifying moment he witnessed his brother being struck, leading to nightmares, intense fear, and emotional distress. Garda Dinah Birnbaum, who investigated the incident, stated that Moynihan had run a red traffic light, hitting André as he crossed the pedestrian crossing. Defense counsel Jane Hyland argued that speed was not a contributing factor and asserted that Moynihan accepted full responsibility for the tragic accident, deeply regretting his actions.
